I do understand this is a post 9/11 US TV show but I'm still amazed by the arguments it's presents at times.
I don't know much about US law, be it civil or military. But in my country we have something called proportionality. An attack helicopters 20mm gun against a civilian in a wooden barn is not a proportional response to the threat. And in the show itself you can clearly see the civilian didn't shoot at the Cobra. The pilot thought he did (why wouldn't they check the helicopter for marks ?) or was just looking for an excuse. Both avenues are presented in the episode but in the end they do what they always do. In court it ends with a legal slap on the wrist but afterwards the pilot gets the morale punishment. Remember the F18 pilot in "Friendly Fire" who bombed the British?
