Openly threatening a CIA officer's family? Hm, I am not sure but shouldn't that probably warrant an arrest right then and there? Sure, Daphne wouldn't get arrested for the "big" crime stuff but she'd at least be out of the picture for now and the CIA could concentrate on Connor.
Even when we ignore this oddly written scene, compared to other shows this version of the CIA comes off as understaffed and weak throughout. Overall the show gets better after episode 3 or 4, the cast and acting is pretty good, but the writing is constantly really convenient and meh. There's definitely some wasted potential here.
